Chelsea have come out with a formal stance on the decision of the Court of Arbitration for Sport in Lausanne (CAS) to cut the club`s penalty for infractions of involving players under 18 by half. Chelsea is grateful to CAS for taking a diligent approach on this matter. The club has not yet received the written explanation for the CAS decision, but wishes to clarify the following:
1. FIFA`s approach in this case was extremely unsatisfactory and in particular FIFA chose to treat Chelsea in a completely different way from that of Manchester City for reasons that have absolutely no meaning to Chelsea.
2. FIFA has accused Chelsea of violating Article 19 of FIFA`s 27 player provisions since 2009. 16 of them were registered by Chelsea in exactly the same way as other Premier League clubs predictions by
partners of live football games at the same time. Chelsea also sought clarification from the Premier League in 2009 about whether they should seek permission to register players in this category. The FA then contacted FIFA and it was confirmed to Chelsea that players in this category could be registered without the need for a specific application form (such a special process did not exist). In this connection, FIFA has indicted Chelsea for this category was wrong. Thank you, this seems to have been corrected by the CAS.
3. With respect to the other 11 players, Chelsea`s position is the following:
(a) Six players were eligible for one of the exceptions to FIFA provisions. Thus, even if there were any violations related to them, they were merely procedural in nature. (b) As for the other five players, FIFA`s position is that it considers that they were registered before any registration form was submitted. Chelsea supports the view confirmed by CAS in the Real Madrid case that FIFA`s provisions do not cover the notion of considered registrations and thus does not agree with FIFA to consider registrations to be canceled before they are actually made.
4. Chelsea respects the importance of FIFA`s ongoing work on the protection of minors and fully cooperated with FIFA during the investigation. However, if FIFA continues to impose constant and unequal sanctions on clubs, then not only will this undermine the true purpose of the rules, but it will also cast doubt on the belief that FIFA is capable of properly regulating this important area.
